Several complaints regarding arrest of Khadija Ismayil, investigative journalist who worked for RFE/Radio Liberty are currently being processed by the European Court of Human Rights

Communication regarding two of those complaints in ongoing. However Khadija Ismayil cannot see the materials regarding the complaints sent to the European Court.

Yalchin Imanov, the journalists’s lawyer, told Radion Liberty that administration of prison number 4 does not allow the documents to be delivered to the journalist, claiming that they are in English.

He added that the prison administration has told him that the documents could be delivered to the journalist after they are translated into Azeri and went through notarial verification.

Yalchin Imanov also said that a letter regarding the issue has been sent to the administration of the Penitentiary Service on January 25.

“In addition to being absolutely illegal and baseless, this ban is also a grave violation of a law. By this ban Khadica Ismayil’s right to defense is de facto violated. If Khadija Ismayil knows English language why extra money has to be spent?” On the other hand, we have to answer inquiries from the European Court as well as the government’s arguments regarding our complaint. And these issues absolutely have to be discussed with Khadija herself. In case the administration of the Penitentiary Service does not stop this lawlessness we will demand this too to be recognized as a violation of right to defense,” istəyəcəyik”, said Yalchin Imanov.

So far, it has not been possible to receive a comment from the Penitentiary Service.
